These Terms govern the use of the mobile application "FarmaScanner" (hereinafter, "App"), developed and distributed by the Developer (hereinafter, "Developer").
The App is intended exclusively for consumer users (natural persons acting for purposes outside any trade, business or professional activity they may carry out).
Installing, downloading or using the App constitutes full acceptance of these Terms.
1. Subject Matter and Nature of the Service
FarmaScanner is a software application that allows users to:
- capture images of receipts and fiscal documents;
- automatically extract data using OCR technology;
- organise and review information for personal purposes;
- generate summaries and tax estimates for informational purposes only.
The App:
- is not a certified tax software;
- is not an official accounting management system;
- is not a legally compliant digital document preservation system;
- is not a fiscal, accounting or legal advisory service;
- does not replace the advice of a tax professional, accountant (commercialista), CAF or other qualified professional.
Any data or calculation provided is intended exclusively for personal informational and organisational purposes.
Note: This App is designed for the Italian tax system (sistema fiscale italiano). All calculations, deduction estimates and fiscal references relate exclusively to Italian tax law and regulations.
2. Licence to Use
The Developer grants the user a licence that is:
- limited,
- non-exclusive,
- non-transferable,
- revocable,
to install and use the App on devices in the user's possession, exclusively for personal and non-commercial use.
Any use other than that expressly permitted is prohibited.
3. Intellectual Property
The App, including its code, structure, design, interface, texts, graphics, logos and related materials, is the exclusive property of the Developer and is protected under applicable intellectual property law.
Use of the App does not confer any ownership rights upon the user.
4. Restrictions
The following are not permitted:
- copying, modifying or creating derivative works of the App;
- decompiling, disassembling or attempting to derive the source code;
- circumventing technical protection measures;
- using the App in violation of applicable law.
4.1 Technical Protection Measures
The App may implement technical security measures aimed at:
- protecting the integrity of the software;
- preventing unauthorised use;
- safeguarding paid features.
Such measures may detect non-standard execution environments (e.g. debug mode, analysis tools, system modifications) and restrict certain features in those contexts.
5. Data Accuracy and Technological Limitations
The App uses automatic recognition technologies (OCR) and algorithms that may produce:
- reading errors;
- incomplete or inaccurate data;
- misinterpretation of amounts or dates;
- duplications or omissions.
The Developer does not guarantee:
- the accuracy of extracted data;
- the completeness of information;
- the conformity of calculations with current Italian tax regulations;
- immediate updates in response to legislative changes.
The user is required to manually verify all data before any use.
6. Tax Calculations and Estimates
Any calculations relating to deductions or thresholds:
- are purely informational in nature;
- do not constitute tax advice;
- do not replace professional verification.
All calculations refer exclusively to the Italian tax system. Responsibility for the correct submission of tax declarations lies solely with the user.
7. Exports and Generated Documents
CSV files, ZIP archives, summaries or other outputs generated by the App:
- do not constitute official tax documents;
- have no certifying value;
- must be verified before use or submission to third parties.
The user is responsible for retaining original receipts in accordance with applicable Italian regulations.
8. Legal Guarantee for Digital Content
Pursuant to European and Italian regulations on digital content (Directive 2019/770 and its implementing legislation), the consumer user is entitled to the conformity of the digital content with the contract.
The mandatory rights provided by law for the protection of consumers remain unaffected.
9. Exclusion of Further Warranties
Without prejudice to applicable mandatory law, the App is provided "as is" and "as available".
No warranties are provided beyond those expressly required by law.
10. Limitation of Liability
To the extent permitted by applicable law:
- the Developer is not liable for indirect, consequential damages or loss of profits;
- the Developer is not liable for tax penalties arising from improper use or failure to verify data;
- the Developer is not liable for data loss caused by improper use or external factors.
The Developer's total liability for damages directly attributable to a contractual breach is limited to the amount actually paid by the user for the App in the 12 months preceding the damaging event, unless otherwise provided by mandatory law.
Any limitation of liability is excluded in cases of wilful misconduct (dolo) or gross negligence (colpa grave), in accordance with Italian law.
11. Informed Use at Own Risk
The user acknowledges that the App is an organisational support tool.
Use of the App occurs with full awareness of the technological limitations described above.
12. Legislative Changes
Tax regulations are subject to change.
The Developer does not guarantee immediate updates to the App following every regulatory or interpretative change under Italian law.
13. Amendments to the Terms
The Developer may update these Terms for legal or technical reasons.
Substantial changes will be communicated to the user with a minimum notice of 30 days, via in-App notification or through official channels. Continued use of the App after the notice period expires constitutes acceptance of the changes.
The updated version will always be available within the App or through official channels.
14. Governing Law and Jurisdiction
These Terms are governed by Italian law.
For consumer users residing in the European Union, the mandatory consumer protection provisions of their country of residence also apply.
Any disputes shall be referred to the court of the consumer's place of residence or domicile, where required by law.
